BURDEN OF PROOF AND RESPONSIBILITY
He went into “recovery" and never came home.
Who carries the burden of proof and who takes responsibility when a young man dies under the watch of a so-called “rehabilitation centre?”
Four of the men accused of the murder of Luke Edwards appeared again in the Umlazi Magistrates Court today. The matter was remanded to 2 December 2025.
Luke entered Tetelestai Recovery Centre (TRC) under the care of Donovan De Klerk (DDK) but he never made it out alive.
Two conflicting stories have been offered up by DDK about what happened that night 8/9 April 2025. Neither adds up.
The phrase “burden of proof” carries immense weight especially in South Africa, where the SAPS and prosecution face the near-impossible task of gathering enough evidence to bring matters like this to trial. Our justice system is buckling under pressure. Money and corruption remain our constant adversaries.
While we await on the next court date, it is worth revisiting the two contradictory accounts offered up by TRC and DDK concerning Luke Edwards and his time there.
VERSION 1: “HE ESCAPED”
According to DDK, Luke allegedly “escaped” in the middle of the night from “intakes” the section where he was being kept under guard.
If this is true, several critical questions must be asked:
• Why was no search conducted to find him?
• Why was Luke’s family not informed immediately?
• Why did TRC fail to alert the SAPS?
If Luke escaped, what was he escaping from and why? Luke was not under any court order to remain at TRC. He was there voluntarily. So why could he not simply walk out by choice?
VERSION 2: “HE WAS RELEASED”
The second story claims Luke was “released” from the facility in the early hours of the morning. Yet, by DDK’s own admission, Luke was suffering from psychosis at the time.
If that was the case, why was he released at night alone, vulnerable, and clearly in no state to fend for himself?
ACCOUNTABILITY
If Luke was killed by people on the street, or as alleged by TRC’s private investigator by the security guards who found him, who bears ultimate responsibility?
Under the Occupational Health and Safety Act, Donovan De Klerk is the 8.1 appointee at TRC. This means the responsibility, legally and morally, stops with him. Even if the so-called “monitors” (inpatients given authority over others) were directly involved, DDK as the person in charge must be held accountable, alongside:
• Dwayne Van Zyl, DDK’s cousin and “assistant manager” (appointed under section 16.2), and
• the directors listed on TRC’s CIPC documentation.
As far as DDK’s fiduciary duties go, it no longer matters who delivered the fatal blow or where it happened. What matters is this: Luke Edwards was left in the care of Tetelestai Recovery Centre and Luke Edwards ended up dead.
Ultimately, the truth will surface and those responsible for Luke's death will pay, as good always prevails over evil.
