‼️ Today, the Michigan Court of Appeals (COA) issued a ruling from the December 13 hearing in the case Mothering Justice v. Attorney General. The COA ruled 3-0 in favor of the State that Michigan’s constitution does not prevent Michigan’s Legislature from adopting and amending a ballot proposal in the same legislative session. ‼️

What Does this Mean for Operators?
▪️ February 19 is no longer an implementation date for an increased minimum wage or tipped wage
▪️ Michigan minimum wage remains at $10.10 per hour
▪️ Michigan tipped minimum wage remains at $3.84 per hour
▪️ No changes to current paid sick leave requirements

"We are relieved and appreciative of the unanimous ‘Adopt and Amend’ decision out of the Court of Appeals today that will allow Michigan and its 18,000 restaurants and hotels to move forward with greater certainty as to their operating future. Through this ruling, countless restaurants and 50,000 hospitality jobs have been at least temporarily saved. We are optimistic that the Michigan Supreme Court will recognize the same and allow this industry to redirect its focus to the daunting task of recovering from a pandemic that decimated it so completely.”

Servers and bartenders say removing the incentive of a tip would result in worse service, lower incomes and higher menu prices at Michigan restaurants.

The Michigan Restaurant and Lodging Association just notified us that it's time to call our Senators. I did and spoke with a person in Senator Victory's office about this matter.

From the MRLA: Last week, Senator Wayne Schmidt (GOP) introduced Senate Bill 1233 as a legislative compromise to resolve a court ruling that would devastate the restaurant industry if not fixed before February 2023. Time is short, however, and to resolve this issue the Senate must pass the bill THIS WEEK.

This article leads me to wonder - to what restaurants Mr. O'Leary is referencing. I'd like to ask those restaurants how things are going and what they're doing to adapt to change. I'm also eager to visit the many successful restaurants that Mr. O'Leary and Saru Jayaraman own and operate in the climate that they encourage. I'm sure they have many answers to my questions.
