Mr. Cherry, you come by whenever I'm set up and you will get some goodies and be able to eat. No questions asked, No Judgements. We all go through hardships and we all should be praying for each other to get through these hardships.

I've been there and I have struggled in times. Ive had people help me and I've been through plenty of hardship where I had nobody to lean on or get help from. Ive come a long ways and all I can do is Pay It Forward. I wont let someone go hungry as long as I have a means to feed them.

Rocky Mount Man Charged With Defrauding Innkeeper Weeks After Pizza Inn Larceny Conviction

ROCKY MOUNT, N.C. — A Rocky Mount man is facing another charge involving allegedly obtaining food without paying, just weeks after court records show he was convicted in a separate case involving a meal at Pizza Inn.

According to Nash County court records, 29-year-old Montez Cherry was charged Thursday, August 27, with misdemeanor defrauding an innkeeper.

The latest charge stems from an incident at the Waffle House located at 101 Rowe Drive in Rocky Mount. According to the charging document, Cherry is accused of obtaining and consuming food from the business without paying. The document states he had been advised that the payment method he used did not have sufficient funds.

Cherry is scheduled to appear in Nash County District Court on October 12, 2026.

The new charge comes approximately six weeks after Cherry was charged in a similar incident at a Rocky Mount Pizza Inn.

Court records show that on July 13, Cherry was charged with misdemeanor larceny after authorities alleged he ate a meal at Pizza Inn without paying and left the restaurant. The value of the meal was listed as $17.49.

Records show Cherry was found guilty in that case and, on July 14, was sentenced to two days in the custody of the Nash County Sheriff. Court paperwork also listed two prior convictions and classified him as a Level II offender for sentencing purposes.

He was also charged with doing the same thing at Sal’s pizza but those charges were dropped

The August 27 defrauding-an-innkeeper charge is a new allegation and has not been adjudicated.

All defendants are presumed innocent unless proven guilty in court.
