On June 25, the Supreme Court of the United States (SCOTUS) threw Americans under the bus, siding with Bayer-Monsanto in Monsanto v. Durnell, further shielding pesticide manufacturers from liability when their products cause harm.
In the majority were Justices Amy Coney Barrett, Brett Kavanaugh (author of the opinion), Clarence Thomas, Elena Kagan, John Roberts, Samuel Alito, and Sonia Sotomayor. The dissenting justices were Ketanji Brown Jackson and Neil Gorsuch.
This ruling is a travesty of justice and a slap in the face of all of Bayer-Monsanto's Roundup cancer victims. Our U.S. Representatives and Senators can and must reverse the ruling.
In the House of Representatives, a bipartisan bill sponsored by Reps Chellie Pingree (D-ME) and Thomas Massie (R-KY) would do just that.
"In wake of SCOTUS's terrible ruling last week in favor of Bayer/Monsanto, Rep Thomas Massie and I just introduced the People Over Poison Act to protect Americans' right to hold pesticide manufacturers accountable under state law when they fail to warn consumers about the risks of their products. Federal pesticide law was never supposed to be a liability waiver for corporations, and not a permission slip to hide behind insufficient labels while people get sick. Enough with the empty slogans and broken promises. If this Administration won't put people's health over corporate profits, Congress must. The right to seek justice in court is one of our most foundational freedoms. We must ensure that every American has a fair chance to be heard and hold powerful interests accountable," wrote Rep Pingree.
In the Senate, Senator Cory Booker sponsored S.2324, the Pesticide Injury Accountability Act in July 2025, a bill that is still active and would ensure that pesticide manufacturers can be held responsible for the harm caused by their toxic products.
