ORDER OF AN EXECUTIVE OFFICER NOTICE OF CLOSURE

To: 1968082 Alberta Ltd. “the Owner”

RE: The food establishment located in Calgary, Alberta and municipally described as: The Winkin’ Owl Pub & Grill
10 – 13750 Bow Bottom Trail SE

WHEREAS I, an Executive Officer of Alberta Health Services, have inspected the above noted premises pursuant to the provisions of the Public Health Act, RSA 2000, c. P-37, as amended;

AND WHEREAS such inspection disclosed that the following conditions exist in and about the above noted premises which are or may become injurious or dangerous to the public health or which might hinder in any manner the prevention or suppression of disease, namely:

a. A substantial amount of mouse droppings were seen in various areas of the facility, including but not limited to: the bar area, dry storage room, kitchen area, and walk-in cooler.
b. The exterior doors leading into the kitchen were heavily damaged, and there were large gaps
on the bottoms of the doors.
c. The exterior back door area had garbage and debris scattered on the ground.
d. There was accumulation of debris inside the bottom cupboards of the bar, on the floor and walls of the dishwashing area, the floor of the storage room behind the bar, the walk-in cooler floor and walls, and the keg line equipment and wall surface behind it.
e. Various lighting fixtures in the kitchen did not have protective covers.

AND WHEREAS such inspection disclosed that the following breaches of the Public Health Act and the Food Regulation, Alberta Regulation 31/2006 and the Food Retail and Foodservices Code exist in and about the above noted premises, namely:

a. A substantial amount of mouse droppings were seen in various areas of the facility, including the bar, dry storage room behind the bar, kitchen, and walk-in cooler room. This is in contravention of the AR 31/2006 s 21(1), which states that the commercial food establishment and any surrounding area, premises or facilities supporting the food establishment must be kept free of pests and of conditions that lead to the harboring or breeding of pests.
b. The exterior doors leading into the kitchen were heavily damaged, and there were large gaps on the bottoms of the doors. This is on contravention of the AR 31/2006 s 17(2), which states the operator must ensure that the commercial food establishment is constructed to prevent the entry of pests.

c. The outside back door area had garbage/debris scattered on the ground within the vicinity, including garbage bags and cigarette butts. This is in contravention of the AR 31/2006 s
21(1), which states that the commercial food establishment and any surrounding area, premises or facilities supporting the commercial food establishment must be kept free of pests and of conditions that lead to the harboring or breeding of pests.
d. There was accumulation of debris inside the bottom cupboards of the bar, on the floor and walls of the dishwashing area, the floor of the storage room behind the bar, the walk-in
cooler floor and walls, and the keg line equipment and wall surface behind it. This is in contravention of the AR 31/2006 s 28(2) which states that a commercial food establishment, all equipment and utensils in it and all surfaces in it in which food comes
into contact must be maintained in a sanitary condition and, without limiting the foregoing, must be washed and sanitized in a manner that removes contamination.
e. Various lighting fixtures in the kitchen were missing their protective covers. This is in contravention of the AR 31/2006 s 23(1), which states that all food used or to be used in a
commercial food establishment must be protected from contamination.

AND WHEREAS, by virtue of the foregoing, the above noted premises are hereby declared to be
Closed.

NOW THEREFORE, I hereby ORDER and DIRECT:

1. That the Owner immediately close the above noted premises.

2. That the Owner immediately undertake and diligently pursue the completion of the following work in and about the above noted premises, namely:
a. Remove and dispose of the mouse droppings.
b. Clean and sanitize any surface contaminated with mice f***s.
c. Hire a pest control company to resolve the pest infiltration issue; complete any suggested work reported by the pest control company.
d. Provide the Executive Officer with a satisfactory pest control report.
e. Repair and/or replace both exterior doors leading into the kitchen area to ensure that pest entry is prevented.
f. Clean and sanitize all surfaces and equipment throughout the food establishment.
g. Remove the debris and clean the outside area around the back door of the kitchen. h. Install light covers on light fixtures in the food handling and food storage areas.

3. That until such time as the work referred to above is completed to the satisfaction of an Executive Officer of Alberta Health Services; the above noted premises shall remain closed.

The above conditions were noted at the time of inspection and may not necessarily reflect all deficiencies. You are advised that further work may be required to ensure full compliance with the Public Health Act and regulations, or to prevent a public health nuisance.
